By making use of our hosting services, you accept these Terms of Service.

1. Acceptable Use Policy#

1.1 Prohibited conduct#

You agree not to use our hosting services for:

  • Hosting illegal, fraudulent, or malicious content.
  • Sending spam or unsolicited emails.
  • Conducting unauthorized network scans or penetration testing.
  • Violating intellectual property rights.
  • Cryptomining or other excessive/abusive use of shared resources.
  • Hosting malware, phishing pages, or exploit code.
  • Circumventing security measures or rate limits.
  • Hosting content that violates another person’s privacy or is used to harass or threaten them.
  • Reselling or subhosting access to our services without prior written permission.
  • Sharing account credentials with third parties.

1.2 Commercial use#

Commercial use is permitted only for individuals and small groups (e.g. clubs, hobby projects) operating on a non-institutional basis. Hosting on behalf of registered companies, larger organisations, or services generating significant commercial revenue is not permitted without prior written agreement.

1.3 Third-party infrastructure policies#

You must also comply with the acceptable use policies of our infrastructure providers (currently Cloudflare, Vultr, and GitHub). A violation of a provider’s policy may be treated as a violation of these Terms.

2. Age#

You must be at least 16 years of age to use our hosting services, in accordance with the age of consent for data processing under the Dutch GDPR implementation act (UAVG). Users under 16 must have the consent of a parent or legal guardian.

3. Data and Privacy#

3.1 Client Data#

You retain ownership of your data hosted on our hosting services. However, you grant Knijn Hosting a non-exclusive license to access, store, and use your data as necessary to provide the hosting services.

3.2 Parties with access to Client Data#

Your data is stored and hosted through the following non-exhaustive list of organisations:

  • Cloudflare Inc., for hosting with Cloudflare Pages, and domain management.
  • Vultr, for hosting non-static web pages and services.
  • GitHub, for storing your static sites (optionally under a private repository).

Some of our providers may process data outside the European Economic Area. Where this occurs, appropriate safeguards (such as Standard Contractual Clauses) are relied upon, as provided by those providers.

3.3 Contact Information#

We collect and retain your email address as necessary to communicate about your hosting services, including billing, support, and changes to these Terms. You may optionally provide an additional contact method (e.g. a Discord handle) for convenience; email remains the primary and authoritative channel for official communications and legal notices.

3.4 Data Deletion#

Upon termination of hosting services, your data will be permanently deleted from our infrastructure within 7 days, except where retention is required by law. You are responsible for exporting any data you wish to keep prior to termination.

3.5 Backups#

You are solely responsible for maintaining your own backups of any data hosted on our services. We do not guarantee the availability of backups and are not liable for data loss.

4. Service Availability#

4.1 Uptime#

While we strive to minimize downtime, hosting is provided on an “as-is” and “as-available” basis. Knijn Hosting is not liable for any damages caused by outages.

4.2 Support#

Paying customers are entitled to support requests being acknowledged within 3 business days, and Knijn Hosting will make reasonable efforts to resolve service-impacting issues in a timely manner. This does not constitute a service-level agreement or a guaranteed uptime commitment.

4.3 Notification of Maintenance#

We will make reasonable efforts to notify you in advance of scheduled maintenance that may affect the hosting services.

5. Termination#

5.1 Termination by you#

You may terminate your hosting services by providing notice.

5.2 Termination by Knijn Hosting#

We reserve the right to suspend or terminate hosting services if you violate these terms, or if continued provision of services becomes impractical or infeasible. Where practical, we will make reasonable efforts to notify you before termination; in cases of severe or ongoing violations, we may suspend access immediately.

6. Indemnification#

You agree to indemnify and hold harmless Knijn Hosting, its employees, and affiliates from any reasonable claims, damages, or expenses arising out of:

  • Your use of the hosting services.
  • Your breach of these terms.
  • Any third-party claims relating to your content or activities.

7. Governing Law and Dispute Resolution#

These terms are governed by the laws of the Netherlands. Any disputes will be resolved exclusively in the courts located in the Netherlands.

8. Amendments#

Knijn Hosting may update these terms from time to time. For material changes, we will provide at least 14 days’ notice via email before the changes take effect. Where you have provided an additional contact method (e.g. Discord), we may also notify you there as a courtesy, but email remains the official notice channel for the purposes of this clause. If you do not agree with the updated terms, you may terminate your hosting services before the changes take effect without penalty. Continued use of the hosting services after the effective date constitutes acceptance of the updated terms. Minor or non-material changes (e.g. clarifications, typo fixes) may take effect immediately.
